The signingsavvy.com website (the “Site/App”) and Signing Savvy Member App (the “App” and collectively the “Site/App”) are owned and operated by Signing Savvy LLC (“we”, “us”, or “our”). Signing Savvy is Deaf owned, Coda owned, and hearing owned.
Please read the following Terms of Use (“Terms”) carefully. By continuing to use the Site, you acknowledge reading the Terms and acceptance and agreement to them, along with the terms and conditions as stated in our Privacy Policy (please refer to the Privacy Policy for more information). If you do not agree to these Terms or Privacy Policy, discontinue the use of this Site.

This Site, and any information available herein, through downloadable resources, or through communication with us, is intended for educational and general informational purposes only. Nothing on this site, downloadable resources, nor communication with us shall be considered a substitute for professional advice. Accordingly, you should consult with a professional regarding your particular situation and circumstances. Your use of this Site and any action, or inaction, taken by you based on the information contained on this Site is at your own risk.

AGE OF CONSENT
By using this Site, you confirm you are at least 18 years of age or have received consent from your parent or legal guardian. Signing Savvy’s Site/App is not specifically directed to children, however, it is directed at anyone interested in learning American Sign Language and accessing an American Sign Language reference tool, which may include people of any age. When creating an account, we state: “I agree that I am 18 years of age or older OR I have received permission from my parent or guardian before creating this Signing Savvy account. When membership is purchased, we assume consent has been granted since a payment method has been provided.”

If you believe a child under the age of 18 has created an account without parent/guardian consent, contact us through our contact form or email address listed at the bottom of this Terms of Use.

Your privacy is very important to us, which is why we've created a separate Privacy Policy in order to explain in detail how we collect, manage, process, secure, and store your private information. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by Signing Savvy LLC.

If you are a Signing Savvy member, you may download or copy the downloadable materials on the Handouts section of the Site for personal use only. ACCEPTABLE USE POLICY
We require that all customers and other users of this Website conduct themselves with respect for others. In particular, observe the following rules in your use of this Site:
- Single-User Account
You are the only person authorized to use your user ID and password to access your account on the Site/App. You shall not permit or allow other persons to have access to or use your user ID and password, except if you choose to provide your user ID / email to Signing Savvy technical support personnel in the course of providing technical assistance. The only exception to this rule is a parent/guardian allowing their minor child or children to use their account. In addition to a parent/guardian allowing their minor child to use their account, we hope they would also use the account together to learn American Sign Language. This allows minor children to use the Site/App without providing their own personal information.
- Provide Accurate Information
In order to access our Site/App, you may be required to provide certain information about yourself (such as identification, contact details, etc.) as part of the registration process, or as part of your ability to use the Site/App. You agree that any information you provide will always be accurate, correct, and up to date. There is one exception to this rule – when an educator with a Signing Savvy Education Membership Account is creating a student account for a child and they wish to provide no personally identifiable information for the student, and do not have a better option, and they notify Signing Savvy at help@signingsavvy.com prior to creating the account that they are doing this. See our Privacy Policy for more information on this exception.
- Account Responsibility
You are responsible for maintaining the confidentiality of any login information associated with any account you use to access our Site/App. Accordingly, you are responsible for all activities that occur under your account/s.
- Accessing Site/App
Accessing (or attempting to access) any of our Site/App by any means other than through the means we provide, is strictly prohibited. You specifically agree not to access (or attempt to access) any of our Site/App through any automated, unethical or unconventional means.
- Abusive Behavior
Do not harass, threaten, or defame any person or entity. Do not contact any person who has requested no further contact. Do not use ethnic, religious, or sexual orientation slurs against any person or group.
- Posting Content
We may provide various open communication tools on our website, such as blog comments, blog posts, public chat, forums, message boards, word lists, newsgroups, product ratings and reviews, various social media services, etc. You understand that generally we do not pre-screen or monitor the content posted by users of these various communication tools, which means that if you choose to use these tools to submit any type of content to our website, then it is your personal responsibility to use these tools in a responsible and ethical manner. By posting information or otherwise using any open communication tools as mentioned, you agree that you will not upload, post, share, or otherwise distribute any content that:
- Is illegal, threatening, defamatory, abusive, harassing, degrading, intimidating, fraudulent, deceptive, invasive, racist, or contains any type of suggestive, inappropriate, or explicit language;
- Infringes on any trademark, patent, trade secret, copyright, or other proprietary right of any party;
- Contains any type of unauthorized or unsolicited advertising;
- Impersonates any person or entity, including any signingsavvy.com employees or representatives.
We have the right at our sole discretion to remove any content that, we feel in our judgment does not comply with this User Agreement, along with any content that we feel is otherwise offensive, harmful, objectionable, inaccurate, or violates any third-party copyrights or trademarks. We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us. We do not assume any liability for any content posted by you or any other third-party users of our website. However, any content posted by you using any open communication tools on our website, provided that it doesn't violate or infringe on any third-party copyrights or trademarks, becomes the property of Signing Savvy LLC, and as such, gives us a perpetual, irrevocable, worldwide, royalty-free, exclusive license to reproduce, modify, adapt, translate, publish, publicly display and/or distribute as we see fit. This only refers and applies to content posted via open communication tools as described, and does not refer to information that is provided as part of the registration process, necessary in order to use our Site/App. All information provided as part of our registration process is covered by our privacy policy.
- Privacy
Do not violate the privacy rights of any person. Do not collect or disclose any personal address, social security number, or other personally identifiable information without each other holder’s written permission. Do not cooperate in or facilitate identity theft.
- Intellectual Property
Attempting to copy, duplicate, reproduce, sell, trade, or resell our Site/App as a whole or a portion is strictly prohibited. Do not infringe upon the copyrights, trademarks, trade secrets, or other intellectual property rights of any person or entity. Do not reproduce, publish, or disseminate software, audio recordings, video recordings, photographs, articles, or other works of authorship without the written permission of the copyright holder.
- Hacking, Viruses, & Network Attacks
Engaging in any activity that disrupts or interferes with our Site/App, including the servers and/or networks to which our Site/App are located or connected, is strictly prohibited. Do not access any computer or communications systems without authorization, including the computers used to provide this Site/App. Do not attempt to penetrate or disable any security system. Do not intentionally distribute a computer virus, launch a denial of service attack, or in any other way attempt to interfere with the functioning of any computer, communications system, or website. Do not attempt to access or otherwise interfere with the accounts of other users of this Website.
- Spam
Do not send bulk unsolicited emails (“Spam”) or sell or market any product or service advertised by or connected with Spam. Do not facilitate or cooperate in the dissemination of Spam in any way. Do not violate the CAN-Spam Act of 2003.
- Fraud
Do not issue fraudulent offers to sell or buy products, services, or investments. Do not mislead anyone about the details or nature of a commercial transaction. Do not commit fraud in any other way.
- Violations of Law
You shall use the Site for lawful purposes only. You shall not transmit through the Site any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law. We reserve the right, in our sole discretion to refuse to provide goods and/or terminate your access to the Site for any breach of this provision or any other provision of these Terms.
Consequences of Violation
Violation of this Acceptable Use Policy (this “AUP”), or any of these Terms, may lead to suspension or termination of the user’s account or legal action. In addition, the user may be required to pay for the costs of investigation and remedial action related to the violations. We reserve the right to take any other remedial action we see fit.
Reporting Unacceptable Use
We request that anyone with information about a violation of this AUP, or any of these Terms, report it via email to the following address: help@signingsavvy.com. Please provide the date and time (with time zone) of the violation and any identifying information regarding the violator, including email or IP (Internet Protocol) address if available, as well as details of the violation.
TERMINATION
We reserve the right, in our sole discretion, to terminate or suspend your account and/or your use of the Site, at any time and for any reason. We are not liable to you or any third-party for any termination or suspension.
NO WARRANTIES
The information on this Site is provided “as-is.” We make no warranties or guarantees, express or implied, regarding the completeness, accuracy, or reliability of any information on this Site or in any products or services provided on this Site. This includes, but is not limited to, warranties of merchantability, noninfringement, or fitness for a particular purpose.
Though we do our best to maintain the Site, we make no warranties nor guarantees the Site and/or downloadable resources are free from viruses, malware, or any other harmful elements.
LIMITATION OF LIABILITY
WE ARE NOT LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY LOSS, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES, WHETHER ARISING IN AN ACTION OF CONTRACT, NEGLIGENCE, TORT OR ANY OTHER ACTION.
INDEMINITY
You agree to protect, indemnify, and hold harmless the Site against any and all claims, demands, losses, damages, actions and causes of actions, including expenses, costs and reasonable attorneys’ fees arising out of third-party claims and/or actions based on your use of the information, products, and/or services offered on this Site.
DISPUTE RESOLUTION / GOVERNING LAW
These Terms shall be construed in accordance with the laws of the State of Michigan.
This website is controlled by Signing Savvy LLC from the state of Michigan, USA. It can be accessed by most countries around the world. As each country has laws that may differ from those of Michigan, by accessing our website, you agree that the statutes and laws of Michigan, without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of this website and the purchase of any products or services through this site.
Furthermore, any action to enforce these Terms shall be brought in the federal or state courts located in Michigan, USA. You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.
Any claim or controversy arising out of the terms of these Terms and/or use of this Site shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and the judgment upon award may be entered in any court having jurisdiction thereof. Any dispute involving any dispute or matter arising under this Disclaimer may only be brought in Michigan.
SEVERABILITY
If any portion of these Terms shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of these Terms is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
WAIVER
The failure of either party to enforce any provisions of these Terms shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of these Terms.
BINDING EFFECT
The provisions of these Terms shall be binding upon and insures to the benefit of parties and their respective legal representatives, successors and assigns.
NOTIFICATION OF CHANGES
We may change these Terms at any time by posting a new version on this page or a successor page. The new version will become effective on the date it’s posted, which will be listed at the top of the page as the new “Effective Date.” We will also notify you of changes by contacting you using the email address on your Signing Savvy account.
